We at Stonemaier recognize the importance of protecting your personal information. What Personal Information Stonemaier Collects

What personal information we collect depends on what Services you choose to use and how you interact with us.

  • Contact information such as name, email address, mailing address, and phone number, while completing an online contact form, as part of a registration, survey, competition or an information request. The data are deleted as soon as they are no longer needed to achieve the purpose for which they were collected.
  • Account information such as any username that you may select in connection with establishing an account on our Sites.
  • Financial and payment information such as information we need to complete a rental including a credit or debit card number.
  • Internet Activity such as your Internet Protocol (“IP”) address, browsing history, your search history and information on your interaction with the Sites.
  • Commercial Information including products or services you have purchased, returned, exchanged, or considered; your preferences.
  • Job Applicant Information including professional or employment-related information (such as education and employment history) and any other information you provide in connection with applying and interviewing for employment at Stonemaier. If we retain you as an employee, this may include, among other things, your Social Security number or taxpayer ID.
  • Other personal information collected online or offline to help us better identify and offer Services and information that we believe may be of interest to you, or help us better understand your experience with our Services.
  • Communications with us including interactions with us and contacts through social media channels, photographs, images, videos, comments, product reviews, testimonials, and other content).
  • Inferences drawn from any of the personal information described above to create a profile about your preferences, behavior, characteristics, and attitudes.
  • Geolocation: location in real time when you have activated this service to offer our products and services depending on where you are located.

How Stonemaier Collects Personal Information

We may collect personal information from various sources, including:

  • Personal information that you provide. We may collect personal information that you provide to us when you create an account or use our Services. Such information may include, but not be limited to, contact information (such as your name, phone number, and email address).
  • Personal information collected when you interact with our Sites. When you visit our websites, open or click on emails we send you, or interact with our advertisements, we automatically collect certain information using online tracking technologies such as pixels, and cookies. If you choose to submit any Personal Information relating to other people, you represent that you have the authority to do so and permit us to use the information in accordance with this Policy.

You may choose not to provide some of your personal information to us, but this may prevent us from providing our Services to you, or limit our ability to provide you with the level of service that you would otherwise expect from us. For example, if you obscure your IP address and you click on a product on our website, you may not be directed to the correct regional webstore.

How Stonemaier Uses Personal Information

To provide the level of service we believe you expect from us, we may use your personal information to:

  • Provide and develop our Services. We collect information to provide our Services, offer support, maintain our Sites, and better understand the interests of our customers. We may also use your information to customize your experience with Stonemaier such as recognizing you when you visit our websites, remembering your preferences, or showing you more relevant advertisements.

  • Security and Fraud Prevention. We may use personal information to monitor, detect and prevent fraud and improper or illegal activity and protect you, Stonemaier, our other customers, and the public. We also use data to secure our online services including our network, websites and apps debug our online services.
  • Comply with Law. To comply with applicable law, comply with Stonemaier’s legal and regulatory obligations, and defend ourselves in litigation and investigations and to prosecute litigation.
  • Applicant. We use Job Applicant Information to make decisions about recruitment and in anticipation of a contract of employment. Providing this information is required for employment.

We may use personal information collected from any of the sources listed in “How Stonemaier collects personal information” section of this policy for our internal business purposes, such as data analysis, audits, developing new products, enhancing our Services, identifying usage trends and determining the effectiveness of our promotional campaigns. We may also use inferences drawn from personal information to create a profile reflecting your preferences.

How Stonemaier Discloses Your Personal Information

Stonemaier may disclose your personal information within the Stonemaier family of companies. We may also disclose your information to our service providers, who act on our behalf, our partners and collaborators, and with other entities at your direction. Stonemaier does not sell personal information or disclose personal information to third parties to use for their own benefit.

Below are more details on the parties to whom Stonemaier discloses data.

  • Service Providers. We disclose certain personal information to service providers that perform services to support our core business functions and internal operations including: fulfilling orders; delivering packages; complying with your request for the shipment of products to; sending e-mails; analyzing customer data; processing credit card and debit card payments; investigating fraudulent activity;
  • Collaborators. Collaborators are partners or other organizations, such as fulfillment centers, with which we jointly develop and/or promote our Services.
  • Public Forums. Some of our websites provide the opportunity to post content in a public forum. If you decide to submit information in these public forums, that information will be publicly available.

How We Protect Your Personal Information

Personal information is maintained on our servers or those of our service providers, and is accessible by authorized employees, representatives, and agents as necessary for the purposes described in this privacy policy.

We realize that individuals trust us to protect their personal information. We maintain reasonable and appropriate physical, electronic, and procedural safeguards designed to help protect your personal information. While we attempt to protect your personal information in our possession, no method of transmission over the internet or security system is perfect, and we cannot promise that information about you will remain secure in all circumstances.

For your convenience, our websites include functionality that allows you to remain logged in so that you do not have to re-enter your password each time you want to access your account. If you choose to remain logged in, you should be aware that anyone with access to your device will be able to access and make changes to your account and may be able to make purchases through your account. The Right to Opt Out of Cookies and Sale/Sharing Using Online Tracking Technologies
Our use of online tracking technologies may be considered a “sale” / “sharing” under applicable law. Visitors to our US website can opt out of being tracked by these third parties by clicking the “Cookies Settings” link at the bottom of our website.

If you do not have a webstore Stonemaier account or if you are not logged into your Stonemaier account, your request to opt out of “sale” / “sharing” will be linked to your browser identifier only and not linked to any account information because the connection between your browser and the account is not known to us.

Categories of personal information disclosed that may be considered “sale” / “sharing”: Basic Identifying Information, Device Information and Other Unique Identifiers, Internet or Other Network Activity, and Commercial Data.

The Right to Accessing, Correcting, and Deleting Personal Information

You may have the right to request access to and receive details about the personal information we maintain about you and how we have processed it, correct inaccuracies, get a copy of, or delete your personal information. You may also have the right to withdraw your consent to our processing of your personal information. If you are a resident of California, Colorado, Connecticut, or Virginia you have the rights to access, correct, and delete personal information under the applicable law (when these laws become effective). If you are a resident of Canada, you have the right to access your personal information and withdraw your consent from processing. These rights may be limited in some circumstances by applicable law.

If you are a Canadian resident and want to withdraw consent to processing, please submit a deletion request by submitting the form, or calling the number, above.

Typically, we retain your personal information for the period necessary to fulfill the purposes outlined in this privacy policy, unless a longer retention period is required or permitted by law. Please note that in many situations we must retain all, or a portion, of your personal information to comply with our legal obligations; resolve disputes; enforce our agreements; protect against fraudulent, deceptive, or illegal activity; or for another one of our business purposes.

Corrections

You may submit a request for a copy of the information collected about you by following the steps outlined in the “Your Rights” section above. California residents may do so for personal information collected in at least the last 12-months. California and Colorado residents may do so up to twice per year per customer.

Responding to Requests

Once you have submitted your request, we will respond within the time frame permitted by the applicable law. Please note that we may charge a reasonable fee for multiple requests in the same 12-month period, as permitted by law.

Appealing Requests

If you are a Colorado, Connecticut, or Virginia resident, you may appeal our decision to your request regarding your personal information. To do so, please contact us in any of the ways listed in the “Contact Us” section, including privacy@stonemaier.com. We respond to all appeal requests as soon as we reasonably can, and no later than legally required.

Identity Verification

For us to process some requests, we will need to verify your identity to confirm that the request came from you. We may contact you by phone or e-mail to verify your request. Depending on your request, we will ask for information such as your name, an e-mail address that you have used with us. For certain requests, we may also ask you to provide details about the most recent purchase you made online or in store.

Managing Communication Preferences

Email

You can stop receiving promotional e-mails at any time by clicking on the “unsubscribe” link at the bottom of any promotional e-mail that you receive from us.

Removing Content from our Public Forums

You can request that we remove content or information that you have posted on a public page on some of our websites (by e-mailing details to Customer Service at privacy@stonemaier.com. Please note that while we will endeavor to honor your request, our removal of your content or information does not ensure complete or comprehensive removal of that information from our website. For example, historical copies, or “caches,” may remain.

Retention

Stonemaier will retain PI for the length of time needed to fulfil the purposes outlined in this privacy policy and for account history purposes unless a longer retention period is required or permitted by law or when needed to manage disputes and claims. Data may also be kept for studies and statistics after having been processed so as to prevent it being reassigned to identified persons. Stonemaier may also need to retain documents that contain PI for a longer period to comply with preservation obligations in litigations and government investigations.

Website Tracking and the Use of Cookies and Other Technologies

If you use our Sites, certain information may be collected from your computer in the course of your use of our Sites. Advertising Cookies

Purpose

The use of advertising cookies makes it possible to determine the advertising content for the promotion of the products and/or services offered on our website exclusively and likely to correspond to the centers of interest deduced from the previous navigation of the terminal concerned, in particular in:

  • counting the total number of advertisements displayed by us on our advertising spaces, to identify these advertisements, their respective number of displays, the number of users who clicked on each advertisement and, if applicable, the subsequent actions carried out by these users on the pages to which these advertisements lead,

How is information collected by Advertising Cookies?

Advertising Cookies are placed on the user’s terminal using tracking technologies (“Tracker”) provided by our partners which are inserted into the pages visited on the Site.

This Tracer will automatically transmit information on the content of the page visited. This information is associated with the identifier contained in the Cookies placed on your Terminal.

How is this information associated?

When you have an online account, or when you place an order, the information collected using advertising Cookies on the Site is reconciled and combined with that from of the use of your account or our products and services and thus make it possible to draw up your user profile which is used for the purposes of advertising targeting and commercial prospecting.

What is the point of seeing advertisements adapted to your navigation?

Occasionally when linking to a third-party website from our Sites, you may still see Stonemaier affiliate logo or a Stonemaier affiliate website frame. This is to provide you with a seamless experience when visiting our Sites. In these cases, you are no longer on our Sites but the third-party website, and therefore the information collection practices of the third party’s website may differ from Stonemaier’s. The privacy notice of the third party website will govern how information collected from you is used by the owner of the website. You can always know what website you are on by checking the Uniform Resource Locator (URL) in the location bar within your browser.

Linking your Stonemaier Accounts to Your Social Profiles

Social Sharing

In an effort to provide our customers with new ways of sharing content, we may enable some of our online content to be shared on social websites through hosted sharing links and icons. Users who share content and links through their social media profiles should be aware that all activities of this nature are public.

Please note, when you share (with or without adding your own comments) any of our content on your social media profile, that action is governed by the privacy notice of that social media platform, and not Stonemaier’s Privacy Notice. We do not track or store a record of those comments or actions.

If you choose to participate in posting or sharing activities, you are electing to share and display such public activities via our Sites. Due to the public nature of your posting or sharing your posts may be included in RSS feeds, APIs and made available to other websites via other formats. As a result, your public activities may appear on third-party websites, blogs or feeds. We are not responsible for any personal information you CHOOSE TO MAKE PUBLIC VIA YOUR SHARED POSTS.

How We Protect the Security of Personal Information

The security of your personal information is important to us. You are responsible for maintaining the strict confidentiality of your account passcode, membership numbers and pin numbers, and you will be responsible for any access to or use of our Sites by you or any person or entity using a passcode provided to you, whether or not such access or use has been authorized by or on behalf of you, and whether or not such person or entity is your employee, relative or agent. In the event of the unauthorized use of your passcode, account, or membership number, or any other breach of security involving your information as it pertains to Stonemaier, you agree to immediately notify us. It is your sole responsibility to ensure that you exit from your account at the end of each session, control the dissemination and use of your passcode, control access to and use of your account and membership number, and notify us when you desire to cancel your account on our Sites. We will not be responsible or liable for any loss or damage arising from your failure to comply with this provision.

In addition, some personal information will be stored on your mobile device if you choose to use our mobile app (“Stonemaier Scores”). In this case, you are solely responsible for protecting the security and integrity of all such personal information, and we are not responsible for any disclosure of personal information or for any use of your account that someone may make using the mobile app on your mobile device, even if such use is not authorized by you.

It is our policy that we will never request your sensitive personal information, such as your credit card number, passcode, membership number or pin number, in an e-mail, text or on a website that is not located at the domain name used by Stonemaier or an affiliate. If you receive an e-mail or other correspondence requesting that you provide any such information via e-mail or to a website that is not on such domain name, please do not provide such information, and report such request to our privacy officer at privacy@stonemaier.com.

Your Marketing Choices

You can opt-out of our use and disclosure of your personal information for marketing purposes and customer satisfaction surveys, and/or withdraw your prior consent for same, by following the instructions included in the email or survey. Upon requesting an opt out, we will work to comply with your request as soon as we can; however, please note that it often takes some time to process these requests. Therefore, it is possible that you may receive promotions scheduled prior to our receipt of your withdrawal of consent.

We may also provide additional methods for you to opt-out of having your personal information used or disclosed for promotional and marketing purposes.

We reserve the right to deny your request if we cannot verify your identify. Where we deny your request in whole or in part, we will endeavor to inform you of the denial, provide an explanation of our actions, and the reasons for the denial.

We will not restrict or deny you access to our Services because of choices and requests you make in connection with your personal information. Please note, certain choices may affect our ability to deliver the Services. For example, if you ask us to delete your email address information from Mailchimp, you will not receive Stonemaier newsletters to that email address.

Mobile and Location-Based Services

Where you consent, Stonemaier may provide apps that can be downloaded to smart phones or other devices. These apps provide services and may collect personal information that will be used in accordance with this Privacy Notice.

Stonemaier apps may use the device’s Global Positioning System (GPS) technology to provide relevant location-based information. To the extent any geo-location data is combined with personal information, that information will be treated as personal information in accordance with this Privacy Notice.

You may stop sharing your location data by adjusting your mobile device’s location services settings. For instructions on changing the relevant settings, please contact your service provider or device manufacturer.

Children’s Privacy

Our Sites and Services are not directed to children under the age of 18. If you are under the age of 18, then please stop using our Sites or our products and Services and do not provide us with personal information of any kind whatsoever. If we learn that we have collected personal information from a child under the age of 18, we will endeavor to delete that information.
